Terms of Service

These Terms of Service (the “Terms”) are a legal agreement between you and GRABBY ALIEN VENTURES LLC (“bluewing”, “we”, “us” and “our”), the makers of the bluewing app, and govern your use of the bluewing mobile app, our website, and related services (together, the “Service”). By creating an account, or by downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

bluewing is an app for building social confidence. It helps you break situations you want to feel more comfortable in into small, gradual steps, practice them, and track how each attempt went.

Not a professional or medical service

bluewing is a personal-development tool for building social confidence. It is not a medical, psychological, therapeutic, or other professional service, is not a medical device, and does not provide diagnosis, treatment, or professional advice. Using bluewing does not create any professional or provider relationship between you and us, and the Service is not a substitute for advice from a qualified professional. If you have concerns about your health or well-being, consult a qualified professional.

The Service is not for emergencies. If you are in crisis or need urgent help, contact your local emergency services right away. In the United States, you can call or text 988to reach the Suicide & Crisis Lifeline.

Practicing new situations is something you choose to do voluntarily and at your own pace. Some situations may feel challenging or uncomfortable, and you are responsible for using your own judgment, deciding what is right for you, and stopping if something does not feel right.

Eligibility

bluewing is for adults. You must be at least 18 years old — or older, if the age of majority where you live is higher — and able to form a binding contract to use the Service. The Service is not intended for anyone under 18, and we do not knowingly let anyone under 18 create an account. By using the Service you represent that you meet these requirements and that the information you give us is accurate. If we learn that someone under 18 has created an account, we may remove it.

Your account

To use most features you sign in with Apple or Google, or with an email address and password. You are responsible for keeping your login credentials secure and for all activity that happens under your account. Let us know promptly at support@getbluewing.com if you believe your account has been used without your permission. You may delete your account at any time from your account settings in the app.

License to use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Service for your own personal use, and for any other use we expressly permit — for example under a plan we offer for coaches, professionals, or organizations. You agree not to resell or redistribute the Service, copy, modify, reverse-engineer, or create derivative works of it, use it to build a competing product, or access it through automated means, except to the extent the law does not allow us to restrict those activities.

Subscriptions, billing, and cancellation

Some features require a payment (“bluewing premium”). We may offer these as auto-renewing subscriptions, as one-time purchases, or as credits or other consumable items, and we may sell them through the Apple App Store or Google Play, through our website, or through another payment processor we use. Today, purchases are made as auto-renewing subscriptions through the Apple App Store or Google Play, and our subscription-management provider (RevenueCat) records your entitlement. The terms below apply to whichever channel you bought through; where the app store you bought from has its own rules, those rules also apply.

  • Payment.Payment is charged at confirmation of purchase — to your App Store or Google Play account when you buy through an app store, or to the payment method you give our payment processor when you buy from us directly. We never receive or store your full payment-card details; our processors handle them.
  • Auto-renewal.A subscription automatically renews for the same period at the then-current price unless you cancel before the end of the current period. For subscriptions bought through the Apple App Store or Google Play, the app store's own rules apply: you must cancel at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before that period ends. For subscriptions bought directly from us, we will show you the billing and cancellation terms — including when you are charged and how to cancel — before you buy, and those terms apply.
  • Cancellation.You can manage or turn off auto-renewal at any time — in your Apple App Store or Google Play account settings for app-store purchases, or through the account or billing tools we provide for purchases made directly from us. Cancelling stops future renewals; you keep access until the end of the period you already paid for.
  • Free trials and offers. If we offer a free trial or introductory price, unused trial time is forfeited when you buy a subscription. Unless stated otherwise, a trial converts to a paid subscription automatically unless you cancel before it ends.
  • Refunds. For purchases made through an app store, refunds are handled by Apple or Google and are subject to their policies; we generally cannot grant those refunds directly, so please request them through the App Store or Google Play. For purchases made directly from us, contact us and we will handle the request under our own refund practices and your local consumer-law rights. Except where the law says otherwise, payments are otherwise non-refundable, and credits or consumables have no cash value and are non-transferable.
  • Price changes. We may change prices and the set of paid features. Where required, we or the app stores will notify you and ask you to confirm before a changed price takes effect.

AI-powered features

Some features use AI — for example, generating a step-by-step plan from a situation you describe. AI output is generated automatically from the content you provide and may be inaccurate, incomplete, or unsuitable for your situation. It is not professional advice, and you should review it with your own judgment before relying on it. You are responsible for what you do with AI-generated content. AI features are optional, and how the content you send is processed is described in our Privacy Policy.

Your content

“Your Content” means the steps and plans you build, your ratings, predictions, notes, logs, comments, and anything else you create or submit in the Service. You keep ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, create derivative works of, publish, and display Your Content in order to operate, provide, improve, and promote the Service.

Apart from Content you choose to publish (see Community features below), we will not publicly display Your Content in a form that identifies you without your permission. Where we use Your Content to improve or promote the Service, we de-identify or aggregate it.

You are responsible for Your Content and represent that you have the rights to submit it and that it does not violate these Terms or the law.

Community features

You can choose to publish a step or plan to the shared library, and to post comments and reactions. Content you publish is visible to other bluewing users. The library is anonymous: what you publish is not shown to other users with your name or other identifying details, though it stays linked to your account so you can manage and remove it. We may later add features that identify who published Content, such as profiles or author names. When you publish Content, you grant us and other users a worldwide, non-exclusive, royalty-free, sublicensable license to view, use, copy, adopt, adapt, publish, and display that Content in connection with the Service — including on our website, where published Content may be publicly visible and indexed by search engines, and in marketing for the Service. If another user adopts a copy of something you published, that copy remains in their account even if you later delete yours.

You agree not to publish or submit Content that:

  • is unlawful, harassing, hateful, threatening, or abusive, or that encourages self-harm, violence, or harm to others;
  • is sexually explicit, or exploits or endangers minors;
  • infringes anyone's intellectual-property or privacy rights, or discloses another person's private information;
  • impersonates any person, is deceptive, or is spam or advertising; or
  • presents itself as medical, clinical, or professional advice.

There is no tolerance for objectionable content or abusive behaviour. Content published to the shared library is subject to review, and anything you post that breaks the rules above may be removed without notice. If you post objectionable content or behave abusively toward other people, we may remove your Content and terminate your account.

Reporting and blocking.Community content can be reported from within the app, and you can block anyone whose content you don't want to see. We review reports and remove Content that breaks these Terms. You can also reach us any time at support@getbluewing.com.

We are not obligated to monitor community content, but we may review, remove, or restrict any Content, and suspend or terminate accounts, at our discretion — for example for violating these Terms. Community content is created by users, not by us; we do not endorse it, and you rely on it at your own risk.

Acceptable use

You agree not to:

  • use the Service in any unlawful way or for any unlawful purpose;
  • interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service, our systems, or other users' accounts;
  • probe, scan, or test the vulnerability of the Service, or circumvent any security or access controls;
  • scrape, harvest, or collect data from the Service by automated means without our permission; or
  • use the Service to develop a competing product or train a machine-learning model.

Our intellectual property

The Service — including the bluewing name and logo, the app, its design, look and feel, text, graphics, illustrations, audio, software, source code, and the methods and know-how behind it, but excluding Your Content and community content — is owned by us or our licensors and is protected by international copyright, trademark, patent, trade secret, and other intellectual-property laws. We reserve all rights not expressly granted to you.

Except for the limited license to use the Service granted above, these Terms give you no rights in our intellectual property. In particular, you may not use the bluewing name, logo, or other brand features — or anything confusingly similar to them — without our prior written permission, including in a way that suggests we sponsor or endorse you. Any goodwill from use of our brand belongs to us.

Third-party services

The Service relies on third parties — including Apple and Google (sign-in and payments), our hosting and authentication providers, RevenueCat (subscriptions), analytics providers, and AI providers. Your use of those services may be subject to their own terms, and we are not responsible for third-party services or content. The Apple App Store and Google Play are not sponsors of, and are not responsible for, the Service.

Apple App Store

If you download the app from the Apple App Store, the following also applies. These Terms are between you and us only, not with Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide any maintenance or support for the app. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the app, and any claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility. Apple is not responsible for addressing any claims you or a third party have relating to the app, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer-protection or similar law. If a third party claims the app infringes their intellectual-property rights, we, not Apple, are responsible for the investigation, defense, settlement, and discharge of that claim. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Changes to the Service

bluewing is a product we are actively building, and it will change. We may add, change, limit, or remove features, and we may suspend or discontinue the Service or any part of it, at any time. Where a change is significant and we can reasonably give you notice, we will — for example in the app or by email. If we discontinue the Service entirely, or remove a paid feature you are currently paying for, we will give you notice where we reasonably can and, where required by law or by the app store you bought through, arrange an appropriate refund for the portion you paid for and did not receive.

Termination

You may stop using the Service and delete your account at any time from your account settings in the app. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, if we reasonably believe it is necessary to protect the Service or other users, or if we discontinue the Service. Provisions that by their nature should survive termination — including content licenses you granted, disclaimers, limitations of liability, and indemnification — survive.

Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, that results (including any AI output or suggested plan) will be accurate or reliable, or that the Service will meet your needs or produce any particular outcome. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

Limitation of liability

To the maximum extent permitted by law, in no event will bluewing or its owners, employees, or providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us for the Service in the 12 months before the claim, or USD 50. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless bluewing and its owners, employees, and providers from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.

Governing law and disputes

These Terms are governed by the laws of Washington, United States, without regard to its conflict-of-laws rules, and the courts located there will have jurisdiction over any dispute, except where the law where you live gives you the right to bring a claim in your local courts or under your local law. Before filing a formal claim, please contact us at support@getbluewing.com so we can try to resolve the issue.

Changes to these Terms

We may change these Terms from time to time. We will post any updated version on this page and update the “Last updated” date above. For material changes we will provide reasonable notice where required — for example in the app or by email. Your continued use of the Service after an update takes effect means you accept the revised Terms; if you do not agree, stop using the Service and delete your account.
